Non-Emergency Medical Transport (NEMT) Retained by U.S. Dept of Health & Human Services

In today's (Friday, April 30) Federal Register, the Centers for Medicare and Medicaid Services (CMS) of the U.S. Department of Health and Human Services (DHHS) issued a final rule on State Flexibility for Medicaid Benefit Packages which retains the provision of non-emergency medical transportation (NEMT).

This reverses an earlier impending final rule in the waning days of the prior Federal administration that was put on hold for review.

The provision on NEMT is in 42 CFR Part 440.390 "Assurance of Transportation" that is found on the very last page of the notice:
